Changes to Maryland Divorce Law Go Into Effect October 2018

In April 2018, legislators in Maryland passed Senate Bill 120, which gave married couples who have children the ability to file for mutual divorce without having to separate for one year. Prior to the passage of Senate Bill 120, married couples seeking divorce had to wait 12 months before they could begin the formal process of divorce. The one exception to this rule was divorce cases involving adultery. In October, these new changes will go into effect in the state of Maryland.

Specific requirements for divorce under the new law are as follows:

  • The spouses have to reach a settlement agreement that provides for the care, custody, access, and support of any minor or dependent children.
  • The spouses must complete the child support guidelines worksheet and attach it to their settlement agreement.

Issues involving marital property also need to be resolved to file for divorce and the spouses will have to live in separate residences. This particular requirement gives couples seeking a divorce an incentive to reach an agreement more quickly.

While eliminating the 12 month waiting period for divorce will cut down the time it takes for a divorce to become final, the overall process is still complex.
